First, the basics - your three options
South African law gives you three ways to hold property in a marriage:
• In community of property - what happens automatically if you marry without a contract.
You share one joint estate, both the assets and the debts.
• Out of community of property (without accrual) - you each keep your own estate, both what you bring in and what you build up during the marriage.
• Out of community of property with accrual — you each keep what you started with, but share the growth built up during the marriage. This applies automatically once you sign an antenuptial contract, unless you choose to exclude it.
To marry out of community of property you need an antenuptial contract (ANC), drawn up by a
notary and registered in the Deeds Office. One golden rule: you must sign it before your wedding day.
Two easy ways to get your ANC

2. Meet with us, in person or online - R3 795 (incl. VAT). Prefer a chat first? We'll talk you through the options, answer every question, and draft your contract while you wait.
Either way it's quick. All we need from you both are copies of your IDs and a recent utility bill. And good to know your contract doesn't have to be registered before the big day. We give you a letter for your marriage officer, and the registered ANC follows from the Deeds Office, usually within about four to six weeks.
Your privacy matters. If you choose accrual and want to exclude certain assets, your net worth won't appear in the document lodged at the Deeds Office.
